These terms govern your use of dpharmacy.ie and any purchase you make from us. By placing an order you confirm that you accept these terms in full.
1. About Us
dpharmacy.ie is operated by O'Flynn's Pharmacy / Total Care Pharmacy Limited ("we", "us", "our"), trading as dPharmacy.
The supply of medicines through this website is regulated by the Pharmaceutical Society of Ireland (PSI) and the Health Products Regulatory Authority (HPRA).
2. Application of these Terms
These terms apply to all orders placed through dpharmacy.ie and sit alongside our Privacy Policy and any product-specific terms shown at the point of sale. The version of the terms that applies to your order is the version published on the website at the time you place it.
We may update these terms from time to time. We will retain a record of each transaction for at least 6 years in line with Irish Revenue obligations and, where longer retention is required by law, for that longer period.
3. Eligibility and Accounts
You must be 18 years or older to place an order. You are responsible for keeping your account credentials secure and for all activity carried out under your account. Notify us immediately at [email protected] if you suspect unauthorised use.
4. Orders and Order Acceptance
Placing an order is an offer to buy. A binding contract is formed only when we send a dispatch confirmation email. Until that point we may decline or cancel your order for any reason, including:
- Stock unavailability
- Failure of payment authorisation or fraud screening
- Pricing or product description errors (see Section 6)
- Suspected breach of these terms
- Pharmacist refusal to supply on safety grounds
- Restrictions on the supply of medicines or other regulated products
If we cancel an order after payment has been taken, we will refund the full amount to the original payment method without undue delay and in any event within 14 days.
5. Pricing and Payment
Prices are shown in euro and include VAT where applicable. Delivery charges are calculated and displayed at checkout before you confirm your order.
We accept the payment methods displayed at checkout. Payments are processed by PCI-DSS compliant providers. We do not store full card details on our systems.
6. Pricing Errors and System Failures
Despite our best efforts, products are occasionally listed at an incorrect price. Where the correct price is higher than the price stated at checkout, we will contact you before dispatch with the option to confirm the order at the correct price or cancel for a full refund.
We reserve the right to reject any order where:
- A product was mispriced due to human, system or third-party data feed error
- The website has been subject to unauthorised access, tampering or interference that affects pricing or availability
- A discount or promotional code has been used outside its intended terms
- We have reasonable grounds to suspect fraudulent activity
In any of the above circumstances you will receive a full refund of monies paid.
7. Delivery
We deliver across the island of Ireland and to selected international destinations. Delivery timeframes and charges are displayed at checkout. Estimated delivery times are indicative and not guaranteed.
All orders are dispatched via tracked courier. Risk of loss or damage passes to you on delivery. If a delivery attempt fails because incorrect or incomplete details were supplied, or because no one was available to accept the parcel after the courier's standard redelivery attempts, additional charges may apply for further redelivery.
8. Your Right to Cancel (Change of Mind)
Under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, you have the right to cancel a non-excluded order within 14 days of receiving it, without giving a reason.
To exercise this right:
- Notify us at [email protected] within the 14 day window.
- Return the goods to us within 14 days of notifying us, in the original packaging, unopened, unused and in resaleable condition.
- Return shipping is at your cost. We recommend a tracked service.
We will refund the price of the goods and the standard outbound delivery charge within 14 days of receiving the returned items or proof of return, whichever is earlier.
Items excluded from the right to cancel
For health, hygiene and patient safety reasons, the following cannot be returned for a change of mind once delivered:
- Medicines, including over-the-counter medicines
- Sealed health, hygiene or personal care items that have been unsealed after delivery
- Goods which by their nature become inseparably mixed with other items after delivery
- Goods liable to deteriorate or expire rapidly
These exclusions do not affect your rights where a product is faulty, damaged, misdescribed or not fit for purpose (see Section 9).
9. Faulty, Damaged or Incorrect Items
If a product is faulty, damaged on arrival, misdescribed, or not fit for purpose, you have rights under the Consumer Rights Act 2022 (Ireland), including the right to a repair, replacement, price reduction or refund depending on the circumstances.
Contact [email protected] within a reasonable period of discovering the issue with:
- Your order number
- A description of the problem
- Photographs of the product and packaging where relevant
We will work with you to resolve the issue. Where a return is required, we will issue an RMA code and cover reasonable return shipping costs.
10. Clearance and Promotional Items
Items marked as clearance or sold under a promotion are covered by your statutory rights in the event of fault, defect or misdescription. Where clearly stated at the point of sale, change-of-mind returns may not be available on clearance items. This does not affect your rights under the Consumer Rights Act 2022.
11. Medicines and Regulated Products
Some products on dpharmacy.ie are regulated medicines or carry age restrictions. By ordering these products you confirm that:
- You are at least 18 years of age
- You have read the product information, warnings and dosage instructions
- You will use the product in accordance with the manufacturer's instructions or the advice of a healthcare professional
- Any information you provided in a required questionnaire is true, accurate and complete
Our pharmacist may refuse to supply a regulated product where they consider the supply unsafe or inappropriate. In that case we will cancel the order and refund any monies paid.
The information on product pages is for general guidance only and does not replace professional medical advice. Consult your GP or pharmacist if you are pregnant, breastfeeding, taking other medication, have an underlying condition, or if symptoms persist.
12. Intellectual Property
All content on dpharmacy.ie, including text, images, logos, layout, design and product information, is owned by or licensed to us. You may not copy, reproduce, republish, scrape, or use this content for commercial purposes without our prior written permission.
13. Data Protection
We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 and the Data Protection Acts 1988 to 2018. Our Privacy Policy sets out how we collect, use, retain and protect your personal data, and your rights in relation to it.
14. Limitation of Liability
Nothing in these terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot lawfully be limited or excluded, including your statutory consumer rights
Subject to the above, our total liability arising out of or in connection with any single order is limited to the price paid for that order. We are not liable for indirect or consequential loss, loss of profit, loss of business, loss of goodwill, or loss of data.
15. Force Majeure
We are not liable for any failure or delay in performing our obligations where caused by events outside our reasonable control, including but not limited to severe weather, industrial action, supplier failure, cyber attack, postal or courier disruption, public health measures or government action.
16. Governing Law and Jurisdiction
These terms are governed by the laws of Ireland. Any dispute arising out of or in connection with these terms or any order placed with us is subject to the exclusive jurisdiction of the Irish courts.
17. Complaints and Dispute Resolution
If you are unhappy with any aspect of your order, please contact [email protected] in the first instance. We aim to acknowledge complaints within two working days and to resolve them within 30 days.
If we are unable to resolve a complaint, you have the right to:
- Use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr
- Contact the Competition and Consumer Protection Commission at www.ccpc.ie
Complaints relating to the professional conduct of the pharmacy may be directed to the Pharmaceutical Society of Ireland (www.thePSI.ie).
18. Severability
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
